In examining deviant movements, firstly, the emergence of these movements and secondly, the people's inclination toward them are of paramount importance. The aim of the present study is to explain the underlying factors of the emergence of and inclination toward the claimed Yemeni movement in Iraq with a focus on jurisprudence of the system. The research method is "descriptive-analytical" using library and online resources. The research finding is that the solution to counteracting the claiming movement of Yamani is paying attention to the jurisprudence of the political system, the jurisprudence of the economic system, the jurisprudence of the cultural system in the seminary of Najaf al-Ashraf, and transitioning from individual jurisprudence thought to social system jurisprudence with all its tendencies. Also, it is essential to note that establishing parallel organizations by the Ahmad Asmā'īl movement is inconsistent with the theory of the political system. On the other hand, the boundary between secular thinking and jurisprudence of the system lies in the ability to combine individual jurisprudence and secular thinking; because the common ground between these two is the separation of religion from politics; whereas in the jurisprudence of the system, there is no duality between religion and politics; rather, politics is an integral part of religion. Based on this, adherence to general opinions is based on the custom of the wise and their tradition, and is fundamentally different from the religion becoming customary, which is the product of the secular perspective on religion.
